Gyms and restaurants sue the city over vaccine mandate

A Bay Ridge bakery, a Staten Island gym and other mom-and-pop shops are suing Mayor Bill de Blasio and the city over the vaccine mandate on indoor venues, claiming the order unfairly targeted their businesses.

Staten Island Judo Jujitsu, Max’s Esca and two other outer-borough businesses are seeking a permanent injunction against de Blasio’s executive order, which he enacted on Monday. 

The businesses say that the order is arbitrary and capricious, because not every indoor venue is included, the choice of certain vaccine thresholds is not defined and that ignoring natural immunity and counting first doses as eligible show a lack of scientific grounding since the Centers for Disease Control and Prevention
